PRIVACY POLICY AND PROCESSING OF PERSONAL DATA

In accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and Organic Law 3/2018 of 5 December, on Personal Data Protection and Guarantee of Digital Rights, the following information is provided regarding the processing of your personal data:

2. PURPOSE

At Bellver College, we process the information you provide in order to deliver the services contracted by the user through our website or via in-person enrolment, as well as to carry out follow-up activities and manage the sending of information and commercial communications.

In order to offer you services that match your interests, we will create a commercial profile based on the information provided. No automated decisions will be made based on this profile.

Personal data provided will be kept for as long as the legal relationship is maintained and deletion is not requested, and for a period of five years from the date of the user’s last contract. In any case, personal data will be retained for as long as they remain useful for the stated purpose, and, in all cases, for the legally established time necessary to respond to any liabilities arising from processing.


3. LEGAL BASIS

The processing of your personal data is based on the performance of a contract to which the data subject is a party, or on pre-contractual measures taken at the data subject’s request. In any case, you have given your consent for your personal data to be processed for one or more specific purposes, in accordance with Articles 6.1(a) and 6.1(b) of the GDPR and Organic Law 3/2018 of 5 December.

Articles 20 and 21 of Law 34/2002 on Information Society Services apply to the sending of commercial offers by electronic means. The prospective offer of products and services is based on the consent requested from you, and withdrawal of this consent will not in any case affect the performance of the contracted service.

Providing personal data is a requirement; otherwise, the requested service cannot be provided, nor can the product be sold, the offer processed, or commercial information sent.


4. RECIPIENTS

Data will not be disclosed to any third party outside the organisation, except where legally required. However, third-party service providers may have access to your personal data as data processors, within the framework of providing services to the Controller.

Furthermore, the Controller may transfer personal data to comply with legal obligations before Public Authorities as required by current legislation.

There is no intention to transfer data to third countries, nor are adequacy decisions, safeguards, binding corporate rules, or applicable specific situations foreseen.


5. RIGHTS

Data subjects have the right to access their personal data and to request rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, data subjects may request the restriction of processing of their data, in which case they will be retained only for the exercise or defence of legal claims. Likewise, for reasons related to their particular situation, data subjects may object to the processing of their data. In such cases, Bellver College will cease processing the data for the purposes to which the objection applies.

Where technically possible, the data subject may request the portability of their data to another data controller.

6. TERMS AND CONDITIONS

6.1

The client expressly accepts the inclusion of personal data collected during browsing on the website, or provided through the completion of any form, as well as those derived from a possible commercial relationship, in the automated personal data files referred to in section 1.

During the data collection process and at each point on the website where personal data are requested, the client will be informed—either via hyperlink or specific mention in the form—whether providing such data is mandatory.

Any client wishing to register on our website must provide the personal data necessary for the requested service, which consists of the provision of the services and/or sale of products offered on the website.

The client/user may exercise, in relation to the data collected as indicated above, the rights recognised in Articles 15 to 21 of Regulation (EU) 2016/679, particularly the rights of access, rectification, deletion, restriction of processing, data portability, objection, and automated individual decision-making, where applicable.

These rights may be exercised by each client through a request form for exercising rights, which can be obtained by email. The written and signed request may be sent by post to Bellver College, Carrer De Josep Costa I Ferrer, 5. 07015 Palma, Balearic Islands, or by email to info@bellvercollege.com.

6.3

Bellver College informs that, if a client or user wishes to register on the website, certain personal data will be requested, the completion of which is mandatory. Therefore, if such data are not provided, registration on the website will not be possible.

It is the responsibility of all users/clients to ensure that the information provided is accurate and up to date. Registration forms that collect personal data indicate which fields are mandatory for registration.

6.4

The automated processing of personal data collected as a result of a request, use, or contracting of any product or service, or any transaction carried out through this website, is primarily intended to maintain the contractual relationship with the website owner.

6.5

The user authorises the sending of advertising about our services and products. Your personal data may be used to manage the sending of advertisements through traditional or electronic means.

Email addresses and personal data provided via the website’s contact form will be used solely to respond to queries submitted through this channel.

Articles 22.1 and 22.2 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (as amended by Royal Decree-Law 13/2012, Article 4) apply regarding the use and processing of personal data for advertising purposes.

6.6

The entity guarantees the confidentiality of users’ personal data. However, Bellver College will disclose personal data and any other information in its possession to the competent public authorities when required in accordance with applicable legal or regulatory provisions.

Personal data may be retained in Bellver College’s files even after the contractual relationship has ended, solely for the purposes stated above and, in all cases, for the legally established periods, and made available to administrative or judicial authorities.
